  • Pedestrians crossing outside a marked or unmarked crosswalk generally must yield to vehicles.
  • A vehicle stopped at a crosswalk may not be passed by other vehicles approaching from the rear.
  • Both drivers and pedestrians share a duty to exercise reasonable care.

How Fault Gets Determined

Because both drivers and pedestrians have legal duties, fault in a pedestrian accident is rarely automatic. Investigators and insurance adjusters look at where the pedestrian was crossing, whether traffic signals were present and working, vehicle speed, weather and lighting conditions, and whether the driver was distracted, speeding, or failed to yield.

Ohio follows a comparative negligence rule found in Ohio Revised Code Section 2315.33, meaning an injured pedestrian’s compensation can be reduced by their own percentage of fault, and recovery is barred entirely if the pedestrian is found more than 50% at fault.
