Why Establishing Paternity Matters

When a child is born to unmarried parents in Ohio, the law does not automatically recognize a legal father the way it does when parents are married. Establishing paternity is the legal process of formally identifying a child’s father, and it matters for far more than a name on a birth certificate. A legally established father gains the right to seek custody or parenting time, and takes on the legal responsibility to provide financial support. Without it, a father has no enforceable rights to see his child, and a mother may have no reliable way to pursue child support.

Three Ways Paternity Gets Established in Ohio

Ohio law provides a few distinct paths to establishing paternity, and which one applies often depends on whether both parents agree on who the father is.

  • Acknowledgment of Paternity Affidavit: Both parents voluntarily sign this form, often at the hospital when the child is born, or later at the local Child Support Enforcement Agency (CSEA) or county vital statistics office. Once filed with the Ohio Department of Job and Family Services’ Central Paternity Registry, it has the same legal effect as a court order.
  • Administrative determination through the county CSEA: If paternity is in question, either parent can request that the CSEA order genetic testing. If results show a 99 percent or greater probability of paternity, the agency can issue an administrative order establishing the father child relationship.
  • Court action: Paternity can also be established through a parentage action filed in Juvenile Court, which may be necessary if a party contests the genetic testing results, if there are competing paternity claims, or if custody and support need to be resolved in the same proceeding.

The Role of the Child Support Enforcement Agency

Ohio’s 88 county Child Support Enforcement Agencies play a central role in paternity cases that don’t start with a voluntary acknowledgment. When a parent requests an administrative determination, the CSEA coordinates genetic testing for the mother, alleged father, and child, typically a simple cheek swab.

If the alleged father doesn’t show up for testing without good cause, Ohio law allows the agency to issue a default order establishing paternity. Once paternity is administratively established, the CSEA can move forward with calculating and enforcing a child support order using the state’s standard support guidelines.

Rescinding or Contesting an Acknowledgment

A signed Acknowledgment of Paternity Affidavit isn’t necessarily permanent. Ohio law gives either parent a limited window, generally 60 days from the date the affidavit was filed, to rescind it without needing to prove anything.

After that window closes, challenging an acknowledgment becomes much harder and generally requires filing an action alleging fraud, duress, or a material mistake of fact, along with requesting genetic testing to support the claim. This is why it’s worth taking the acknowledgment process seriously rather than treating it as a formality.

What Comes After Paternity Is Established

Once paternity is legally established, either parent can ask the Juvenile Court to allocate parental rights, set a parenting schedule, and order child support. Establishing paternity doesn’t automatically grant a father custody or specific visitation, that generally still requires a separate custody or parenting time order.

But it does open the door to seeking those things, and it gives the father a legal voice in decisions about the child’s welfare, education, and medical care going forward.

  • Legal fatherhood affects inheritance rights, eligibility for the child to receive benefits like Social Security or veterans’ benefits through the father, and health insurance coverage options.
  • Support obligations are calculated using Ohio’s child support worksheet, which factors in both parents’ incomes, health insurance costs, and childcare expenses.
  • Either parent can later request a custody or parenting time order once paternity is on record.
