What Does Zero Tolerance Mean in Ohio?

Ohio is a zero tolerance state when it comes to drivers under the age of 21 and alcohol behind the wheel. While drivers 21 and older are legally impaired at a blood alcohol concentration of .08 percent or higher under Ohio Revised Code 4511.19, drivers under 21 can be charged with a distinct offense at a far lower threshold of just .02 percent. Given how little alcohol it takes to reach that level, this law effectively treats any detectable drinking before driving as off-limits for underage drivers throughout Ohio, including families across Hamilton, Butler, Warren, and Clermont counties.

This underage-specific offense is commonly referred to as OVUAC, short for Operating a Vehicle After Underage Consumption. It’s a distinct charge from a standard adult OVI, though the two can overlap depending on the driver’s actual BAC level.

How OVUAC Differs From a Standard OVI Charge

The dividing line in Ohio law generally comes down to blood alcohol concentration:

  • BAC below .02 percent: Generally not subject to an OVI or OVUAC charge based on alcohol concentration alone

  • BAC of .02 percent up to .08 percent: Subject to an OVUAC charge as an underage driver

  • BAC of .08 percent or higher: Subject to a standard adult OVI charge under R.C. 4511.19, even though the driver is under 21

This structure means a young driver can face two very different sets of consequences depending on exactly how much alcohol is detected, and it’s why the specific test result in an underage case is so significant.

License Suspension for Underage Drivers

An underage driver arrested on suspicion of OVUAC can face an immediate administrative license suspension, similar in concept to the ALS that applies to adult OVI arrests, imposed by the Ohio Bureau of Motor Vehicles at the time of arrest. Beyond the administrative suspension, a resulting OVUAC conviction can lead to an additional court-ordered suspension, with total suspension periods commonly ranging from several months up to two years depending on the circumstances and any prior record.

If an underage driver refuses chemical testing altogether, they remain subject to license suspension consequences for that refusal as well, similar in spirit to the implied consent rules that apply to adult drivers.

Additional Consequences Beyond License Suspension

An OVUAC conviction can carry fines, required alcohol education or treatment programs, and a permanent record that may need to be disclosed on future applications for jobs, college programs, or professional licenses. For a first-time OVUAC offense, Ohio courts often have discretion over exactly how these consequences are applied, but the underlying record of the charge itself does not simply disappear.

Because these cases often involve younger drivers with little to no prior record, courts in Southwest Ohio may be more open to alternative resolutions in appropriate cases, but this is far from guaranteed and depends heavily on the specific facts, including the driver’s BAC, driving conduct, and any prior history.
