What Is an Ignition Interlock Device?

An ignition interlock device, sometimes called an IID, is a breath-testing unit wired into a vehicle’s ignition system. Before the car will start, the driver must blow into the device, and the vehicle won’t start if the device detects alcohol above a set, very low threshold. Ohio administrative rules define these devices in detail and require that only state-certified interlock systems be used, ensuring some measure of consistency and reliability across providers used throughout Ohio, including here in the Cincinnati area.

For many drivers convicted of OVI, or those seeking early driving privileges after an arrest, an interlock device becomes a central part of daily life for months or even years.

Annie’s Law and Unlimited Driving Privileges

Ohio significantly changed how ignition interlock devices work with the passage of what’s commonly known as Annie’s Law, codified largely at Ohio Revised Code 4510.022. Before this law, many OVI offenders faced strict limited driving privileges, only permitted to drive for narrow, court-approved purposes like work or medical appointments.

Under Annie’s Law, many first-time OVI offenders can instead petition for unlimited driving privileges during their suspension period if they agree to install a certified ignition interlock device. This allows broader driving access than a traditional limited privilege, in exchange for the accountability the device provides. Courts throughout Butler and Warren counties have discretion in how they apply this option, so the specific outcome can vary based on the facts of the case.

Who Is Required to Use an Interlock Device?

While the Annie’s Law option is often framed as a choice for first-time offenders, ignition interlock devices become mandatory rather than optional for many repeat offenders. Drivers with a second, third, or subsequent OVI conviction within the relevant look-back period frequently face court orders requiring interlock installation as a condition of any limited or restricted driving privileges, sometimes for a year or more depending on the offense level.

It’s also worth noting that under Ohio Revised Code 4511.196, a hard suspension period, often around 15 days for a first offense, must pass before a court can grant any limited driving privileges, interlock or otherwise. This waiting period cannot typically be waived by agreement.

Costs and Practical Considerations

Ignition interlock devices are not free. Drivers are typically responsible for installation costs and ongoing monthly monitoring fees charged by the certified interlock provider, in addition to any court costs and fines from the underlying OVI case. Devices generally require periodic calibration and data downloads at a certified service center, which means regular appointments throughout the required period.

Ohio law treats interlock violations seriously. Tampering with the device, attempting to start the vehicle after a failed breath sample, or allowing another person to start the vehicle for you can all constitute violations under Ohio law, and can lead to an extended suspension period or revocation of limited or unlimited driving privileges altogether. Courts in the greater Cincinnati area generally have little patience for attempts to circumvent an interlock requirement once it has been ordered.
